City Backpedals on Plan to Ban Earplugs for Bicyclists

Law Director Kevin Butler said that the administration needs more time to consider the measure.

The city of Lakewood is postponing a proposal that would keep bicyclists from wearing headphones while riding in Lakewood.

Lakewood ordinances prohibit motorists from wearing headphones while driving, but the law on the books doesn’t apply to bicyclists.

City officials are considering a measure that could change that.

The original plan was to introduce the ordinance to city council at Monday night’s scheduled meeting.

But Kevin Butler, the city’s law director, said the administration needs more time to consider the proposal.

“We need to get more background,” he said. “We’re looking for more input from the bike folks and police department."

“We just want to learn more.”

Ashley Belzer, the city’s assistant prosecutor and assistant law director, said Monday that the proposed ordinance would require bicyclists to pull out an earplug to focus more on traffic.

However, bicyclists would still be allowed to keep one earplug in. 

“Police officers have been seeing (bicyclists) more and more often wearing earplugs in both ears,” she said. “On bicycles, people sometimes don’t follow traffic laws as they would if they were in a car. People get a little more lax on bicycles.”

According to the original plan, the new law would make the first offense a minor misdemeanor, punishable with up to a $150 fine. A second offense committed within one year of the first, would become a fourth-degree misdemeanor.

When I ride I can hear a lot more with my headphones in then I can while inside a car with the radio on. For a city that is pushing to be very bike friendly this seems very counter productive.

I love when these idiots are riding on Lake and Clifton at 5:30 in the middle of rush hour not going anywhere near the speed of traffic or following traffic laws with their earphones in. If you want a bike-friendly city, follow the rules.

I guess you don't understand that bikes have just as much right to be on the road as your car does. Also its not a law that bikes can't have headphones. That's what this whole thing is about.

When I ride my bike, and I ride fairly often on the streets, I use my ears as much as my eyes. I think it's foolish for a cyclist to use earbuds while cycling. That said, the libertarian streak in me says we have too many rules already....

You're right, I DON'T understand your assertion that bikes have a right to the road. The do not, and cannot, travel as fast as cars and traffic.A bike in the road is the equivalent of a car going 5mph down the street; everyone has to slow down and change lanes to go around them. Should pedestrians be allowed to walk in the street? No, that is what sidewalks are for. If you can't ride your bike as fast as I can drive my car, the city should limit you to the sidewalk.

Are any of the residents willing to do that, or their families/friends? The oldest could sit in chairs with signs. Signs could say things like "The Westerly is throwing grandma to the curb" or "Evicted by Big Money". I'm just shooting from the hip here but you get the idea. I would come out as a supporter. I have few contacts in that building, but the two that I do have are activists. Could you organize something like this with your contacts? Look out Westerly, you will be on the news and it won't be pretty.
