Bond Set for Waterbury Avenue Shooting Suspects

Man shot in the leg during the robbery-gone-bad is charged with felony murder of his stepbrother, who he is accused of committing the Jan. 6 robbery with.

Two of the men involved in the appeared in Cuyahoga County court on Tuesday to face charges stemming from the Jan. 6 incident.

They both face new charges.

Andre Daniel, the Lakewood man who of 17-year-old Charles Wilson, of Cleveland, faced only a charge of felonious assault for the suspected shooting of Frederick Burt, 20, of Cleveland.

Common Pleas Court Judge Maureen Clancy set his bond at $25,000 cash/surety. 

Police officials have said that stepbrothers Burt and Wilson went to 2051 Waterbury Avenue to rob the home Jan. 6.

Police say that a , and shot and killed Wilson.

Burt ran out of the home and was shot in the leg in the driveway. Police now believe that Burt was shot by Daniel.

Both of them appeared in court Tuesday, via a video conference.

Burt, appeared before the judge in a wheelchair, still recovering from his gunshot wound, was charged with aggravated robbery and felony murder — a statute designed to charge a suspect when someone is killed during the commission of a felony.

“He wasn’t there to wish anyone a happy birthday,” said Lakewood Law Director Kevin Butler. “He was there to commit a very heinous crime, an armed robbery. That’s why this statute exists.”

Burt’s bond was set at $500,000 cash/surety. 

A Cuyahoga County grand jury is expected to convene this week, and new charges may be filed, said Maria Russo, the spokeswoman of the Cuyahoga County Prosecutor’s Office. 

The 17-year-old boy arrested for killing Wilson is expected to be charged as an adult, said Russo.
